1. Acceptance of Terms
By accessing or using our website, courses (including Tutor LMS), and community features (the “Services”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old and able to enter a binding contract to use the Services.
3. Accounts & Security
- Provide accurate registration information and keep it up to date.
- Safeguard your login credentials; you are responsible for all activity under your account.
- Notify us promptly of any unauthorized access or security concern.
4. Intellectual Property
All content, including text, videos, downloads, worksheets, branding, and trademarks (including Pragmatic Idealism™), is owned by EPD Publishing LLC or its licensors and protected by law.
5. Certification Program & Trademark Use
The Pragmatic Idealism™ Certification Program (the “Certification”) is offered as a separate course track. Enrollment in a Certification course grants additional rights and responsibilities as outlined below:
- Certification Rights: Upon successful completion, graduates may represent themselves as a “Certified Pragmatic Idealism™ Coach.” This includes the right to reference the certification in professional bios and marketing, subject to these Terms.
- Use of Trademarks: Certification does not grant ownership of the Pragmatic Idealism™ name, logos, or materials. Graduates may use the phrase “Certified Pragmatic Idealism™ Coach” to describe their credential but may not use our trademarks or logos in a way that implies they are an employee, partner, or official representative of EPD Publishing LLC.
- Use of Materials: Course templates and tools provided for certified coaches are licensed for personal professional use with clients. They may not be sold, sublicensed, or distributed as standalone products.
- Revocation: EPD Publishing LLC reserves the right to revoke certification if a graduate violates these Terms, misuses trademarks, or engages in conduct that harms the reputation of the Certification or the Pragmatic Idealism™ brand.
- No Guarantee of Employment: Certification indicates completion of our training program but does not guarantee employment, client results, or business success.
License: We grant you a limited, non-exclusive, non-transferable license to access course content for your personal, non-commercial educational use while your access is active.
Restrictions: You may not copy, reproduce, distribute, share, resell, or publicly display course materials without our prior written permission.
6. Payments, Refunds & Taxes
- Payments: Fees are due at enrollment and may be processed by third-party payment processors (e.g., Stripe).
- Refunds: We offer a 14-day refund if you have completed less than 10% of the course. To request a refund, contact hello@PragmaticIdealismGuild.com with your order details.
- Taxes: You are responsible for any applicable taxes, which may be added at checkout.
7. Course Access & Changes
- We may add, modify, or remove course modules or features to improve quality or compliance.
- We may suspend or terminate access for violations of these Terms or unlawful conduct.
- Community features are provided as a courtesy and may be moderated or discontinued at our discretion.
8. Prohibited Conduct
- Sharing your login or allowing unauthorized access.
- Uploading malicious code, scraping, or interfering with the Services.
- Harassing, abusing, or doxxing others; posting illegal or infringing content.
- Using materials for commercial purposes without permission.
9. Educational Disclaimer
Our content is for educational and informational purposes only. We do not provide legal, medical, psychological, or financial advice. Individual outcomes vary.
10. Disclaimers; Limitation of Liability
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, or data.
11. Indemnification
You agree to indemnify and hold harmless EPD Publishing LLC and its officers, directors, employees, and agents from any claims arising out of your use of the Services or violation of these Terms.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Venue for any dispute shall be the state or federal courts located in California, and you consent to their jurisdiction.
13. Changes to Terms
We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms.
